Trusts that address special needs provide asset protection for individuals with disabilities and the elderly, enabling them to receive government benefits through Medicaid, Social Security Disability Insurance and Supplemental Security Income. The protected assets are used solely to care for the individual.

In his presentation, “Putting a Human Face on an SNT: The Beneficiaries of SNTs,” Amoruso reviewed the “one size does not fit all” concept in special needs trust drafting. He addressed how special needs trusts are developed for different types of individuals and the impact of beneficiaries on the trust administration.

“Special needs trusts are especially important for those who are unable to handle their personal finances,” said Amoruso, “and each individual’s circumstances are unique.”

“There are myriad advantages to preparing special needs trusts, including preserving eligibility for government benefits while insuring that there are assets available to pay for needs not covered by government benefits. They also protect the depletion of case settlements to pay for health care. Most importantly, special needs trusts provide families with peace of mind, knowing that they are helping to properly care for their loved ones,” he added.
