New Hampshire Woman Killed in Motorcycle Accident

Keene, NH (Law Firm Newswire) February 11, 2011 - This wreck was as much about negligent driving as it was about the issue of seniors still having driver’s licenses.

The Lees were out riding on their motorcycle one day, never thinking they would be involved in an accident; a fatal accident that would kill Sheila Lee and injure her husband, Norman. “The accident happened without any warning, as 81-year-old Wilma Stender abruptly turned her car right into the path of an oncoming motorcycle,” said Charlie Donahue, a New Hampshire personal injury lawyer located in Keene. Donahue handles injury cases in New Hampshire and across the United States.

Norman Lee had nowhere else to go and despite trying to avoid an accident, he and his wife slammed into the side of Stender’s car. The crash shut the highway down for several hours while EMS crews dealt with the accident and took people to hospital.

“Although Sheila Lee made it to hospital alive, she died later of injuries sustained in the wreck. The police charged Stender with felony negligent driving,” Donahue said. Her first hearing in court would be in early January.

Norman Lee would likely want to speak to a qualified New Hampshire injury lawyer to find out how to file a wrongful death lawsuit. “There are a whole lot of issues the plaintiff would want answers to, not the least of which is how will he ever deal with his the loss of his life’s companion and wife? Given his own injuries, he may wish to file a personal injury lawsuit, in addition to a wrongful death lawsuit, as he is entitled to compensation for his injuries,” Donahue said.

The role of a New Hampshire personal injury lawyer, in a case like this, is one of plaintiff’s advocate, to ensure he gets a fair and equitable settlement or jury verdict. This is why legal counsel needs access to all the evidence gathered at the scene of the crash, all medical documentation and other information that would demonstrate the negligence of the other driver.

“The key in cases like this is proving negligence on the part of the other person. Here, the fact that the woman turned right into the path of an oncoming motorcycle certainly indicates she was not paying attention to what she was doing. Or, as they say in legal terms, res ipsa loquitur, the thing speaks for itself. But for the fact that the woman wasn’t paying attention to what she was doing while driving, Sheila Lee would still be alive today,” said Donahue, a New Hampshire personal injury lawyer located in Keene.
