Drivers who have a blood alcohol level of .08% or higher are classified as alcohol impaired. Authorities are especially concerned about alcohol impaired drivers during the nighttime hours, as midnight to 3 a.m. is known as the time when most drunk driving fatalities occur. The National Highway Traffic Safety Administration notes that an average of three DUI fatalities happen every hour nationally during this three-hour timeframe.

Accidents caused by drunk drivers subjects them to criminal prosecution and civil claims to compensate the victim for his or her medical bills, lost wages, pain and suffering, and property damage. In instances where death occurs, claims for wrongful death and survivorship will also arise.
