Two Florida Counties See an Increase in Traffic Deaths

Lakeland, FL (Law Firm Newswire) August 23, 2012 - Fortunately, the increase in traffic deaths in Palm and Broward counties is small, but it is not exactly clear what is causing them.

The focus seems to be on distracted driving. One might have assumed immediately it was driving under the influence, but distracted driving can cause drivers to have the same or similar handicaps, such as delayed reactions and inattentiveness.

In Florida, there are no laws against distracted driving, though there are in other states. Someone could be driving in Florida, not intoxicated, but texting, and still be within the law. Distracted driving kills thousands of people in the United States each year. State Representative Irv Slosberg has helped pass several traffic safety laws since his teen daughter was killed in 1996. He suspects distracted driving explains the increase in traffic deaths.

Bicyclists and pedestrians may be the most at risk from distracted drivers, because they simply do not see non-motorists at all, perhaps due to their relative quietness and smaller size. At any rate, there is a peculiar imbalance in the laws, because they allow one activity while driving that results in the deaths of far too many people, and rightly prohibit driving while under the influence of alcohol, and other substances.

“What we are seeing makes no sense for public safety,” said Florida DUI defense attorney Thomas C. Grajek. "Considering the fact that texting is very popular with teens, and they are novice drivers, it would make them even more susceptible to causing accidents. Without sensible laws governing distracted driving, the number of traffic deaths in Florida may increase further. Sadly, most if not all of these distracted driving accidents could be prevented."
