Biker and Passenger Killed Instantly in Broadside Crash

Austin, TX (Law Firm Newswire) October 15, 2012 – A motorcycle is thrilling, but bikers live on borrowed time. In this case, two bikers lost their lives in a devastating wreck with a pickup truck.

“One of the hardest accident scenes to see is a motorcycle that has been broadsided. The damage it does is graphic, horrific and hits you with a visceral punch in the abdomen. There is debris from one end of the road to the other and in some instances, body parts. You have to say a mental prayer for those that lost their lives, as they were right out there in the open, with no protection,” said Bobby Lee, an Austin personal injury attorney of Lee, Gober and Reyna in Austin, Texas.

The biker in this case was riding south, heading home at about 1:30 a.m., when the light at the intersection turned red. For some reason, the biker did not stop. As he entered the intersection, he was broadsided by a Dodge pickup, heading east. The truck driver had a green light, and he had no place to go when the biker crossed in front of him. The truck rammed into the right side of the bike, tossing it, the driver and his passenger onto the shoulder of the road, where they both slammed into a traffic control box. The force of the impact was so great that it took out power to the traffic signals.

“When first responders arrived, both the biker and his female passenger were pronounced dead at the scene. Neither had been wearing a helmet, but given the nature of the impact, and how they were thrown into the metal pole, a helmet may not have saved them,” added Lee.

In a case such as this one, the family of the deceased female motorcycle passenger would more than likely file a wrongful death lawsuit, as it was clear from the accident reconstruction, that the biker blew a red light. “That is negligence. Whether or not he had been drinking as well, or was also speeding, remains to be seen, but the fact that he did not stop for a red light is cause enough to file a wrongful death lawsuit,” Lee indicated.
