Judgment obtained against Wells Fargo Bank

Phoenix, AR (Law Firm Newswire) August 21, 2013 – The law firms of Weisberg & Meyers LLC and Greenwald Davidson PLLC announce that they have obtained judgment against Wells Fargo Bank South Central, N.A. for violations of the Telephone Consumer Protection Act (“TCPA”) and Texas Business & Commerce Code § 305.053. The judgment, entered in the Western District of Texas, also enjoined Wells Fargo from placing further telephone calls using an automatic telephone dialing system, without the plaintiff’s consent, to his cellular telephone.

The case, Masters v. Wells Fargo Bank South Central, N.A., Case No. A-12-CA-376-SS, involved numerous telephone calls made by Wells Fargo’s overdraft collections department to the plaintiff’s cellular telephone using an automatic telephone dialing system, without the plaintiff’s consent. Indeed, Wells Fargo placed these telephone calls to the plaintiff’s cellular telephone, in violation of the TCPA, after being informed by the plaintiff that Wells Fargo was dialing the wrong telephone number.

The TCPA is a federal law that, among other things, makes it illegal to use an automatic telephone dialing system or a prerecorded voice to call cellular telephones without prior express consent. The TCPA allows individuals who receive such telephone calls or text messages in violation of the statute to sue for $500 in damages for each violation. In some cases, courts can award triple damages, of $1,500 per telephone call, for willful violations of the TCPA.
