Boehner’s Potential Lawsuit Looms Over Obama

Miami, FL (Law Firm Newswire) August 27, 2014 – Rather than deal with issues that concern the nation, including immigration reform, House Speaker John Boehner has diverted attention to a lawsuit he is filing against President Obama.

“It’s incomprehensible why Boehner would do something this nonsensical when an election is knocking on the door. His lawsuit alleges that the President is not executing the laws of the land by using his executive actions to change laws. The Obama administration strategies are old news, which makes his actions even stranger — until examined under the magnifying glass of potential political gain for the election,” mused Larry Rifkin, a Miami immigration lawyer.

The announcement of the lawsuit was missing a description of precisely which executive action the lawsuit may target. Some speculate that it targets Obama’s offer to defer the deportation of young students who arrived in the country illegally just before the last presidential election.

Boehner couched his announcement in the sanctity of the Constitution. He claims that someone had to stand up for the institution and fight for what is best for Congress. But no one seems clear on his meaning, and there is little information on the specifics and allegations of the case. A great deal is still open to speculation – the perfect milieu for rumors, accusations and misinformation to run rampant while politicians are preparing for an election.

Is impeachment on Boehner’s mind? Boehner stated he is only making an issue of the President faithfully executing the laws of the country, as he should do according to his duty under the auspices of the Constitution.

True intent aside, major media has indicated that a group called the Bipartisan Legal Advisory Group (BLAG) may handle the mechanics of the suit.

“It’s more than just interesting that BLAG is controlled by the Speaker, the Minority and Majority Whip and the Minority and Majority Leader. Republicans could conceivably demand that the lawsuit proceed in the face of Democratic objections,” said Rifkin.

However, a smoke-and-mirrors lawsuit may actually demonstrate that Republicans have forced Obama to exercise more executive actions than he should have had to. And Boehner is considering using a taxpayer-funded lawsuit against the President for doing his duly elected job. The plan may not only backfire, but also incur the wrath of taxpayers.

In the final analysis, the prevailing opinion of Nancy Patricia D’Alesandro Pelosi, the Minority Leader of the United States House of Representatives, is that the lawsuit is nothing but “subterfuge” to make it appear that Republicans are achieving something in Congress.
