Austin, TX (Law Firm Newswire) August 24, 2016 – An off-duty police officer with the El Paso Police Department was the proximate cause of a recent horrific accident.

Officer Alan Dieguez, with three years of service, was involved in a fatal accident recently that resulted in one death and numerous injuries. Dieguez was driving while intoxicated on I-35 near Jarrell when the crash happened.

According to local police reports there were four vehicles — three big rigs with trailers and Dieguez’s Hyundai Velocitor— involved in the accident. It was shortly after 2 a.m. when Dieguez, who was allegedly speeding and erratically weaving in and out of traffic at 100 mph, rear-ended an 18-wheeler. As a result of the impact, the Hyundai ended up in the ditch leaving behind vehicle debris.

A second 18-wheeler had to attempt to swerve to miss the material in the road, the Huyndai’s engine and various parts, causing it to lose control and skid into the northbound lane and burst into flames. Yet another truck hit the road debris and caught on fire. Troopers shut down that portion of I-35 down for many hours to deal with the three wrecks. The driver of the second big rig was pronounced dead at the scene.

Dieguez was taken to the local hospital where he allegedly fled after refusing treatment. Once arrested, the police took him to jail and charged him with unlawful carrying of a weapon and DWI. He bonded out of jail the same day he was arrested. His home police department in El Paso put him on administrative leave and his personnel file indicates he has been involved in a previous accident where he was disciplined.

“This accident would never have happened had Officer Dieguez not chosen to drink and drive at excessive speeds,” said Bobby Lee, an Austin personal injury lawyer, not involved in this case. “Drinking and driving is never OK. It is even worse if law enforcement, sworn to uphold the laws relating to DUI and DWI, flaunt the laws.”

Lee, Gober & Reyna, Austin personal injury attorneys, represent plaintiffs who have been involved in accidents in which there was one or more intoxicated driver. “We see far too many seriously injured people who were in the wrong place at the wrong time and met up with an inebriated driver. It’s a devastating thing for victims to try and recover from an accident that may have left them catastrophically or seriously injured. Our door is open to you. We’re here to advise you of your rights and pursue compensation should you choose to file a lawsuit,” said Lee.
