Florida Wrongful Death Lawsuit Filed Over Wrong-Way Crash

Tampa, FL (Law Firm Newswire) June 20, 2017 – A wrongful death lawsuit has been filed on behalf of the family of a Florida woman who was killed in a wrong-way crash on an Interstate 95.

According to authorities, Jennifer Levin was driving north in the southbound lanes of I-95 when she struck the vehicle driven by 91-year-old Octavie Morand, who died from her injuries the day after the collision. A report from the Florida Highway Patrol stated that Levin was driving under the influence, and she was charged with DUI manslaughter.

“Losing a loved one is even more tragic when it is caused by an accident that could have been prevented,” said Robert Joyce, a Tampa wrongful death attorney with the law firm of Joyce & Reyes, who is not involved in the case. “When someone is killed because of the negligence of another, the family is entitled to seek compensation from the wrongdoer through the legal system.”

According to the Florida Highway Patrol, Levin failed a field sobriety test and her blood alcohol level was measured as .153, which is nearly twice the allowable limit. Troopers also reported that Levin had drugs in her system. According to the Morand family’s attorney, Levin had been charged with driving the wrong way on a previous occasion. She was released on bond and scheduled for a pretrial appearance in the criminal case against her.

According to the Centers for Disease Control and Prevention (CDC), there were 9,967 deaths nationwide in alcohol-impaired driving collisions in 2014, accounting for almost one-third of all traffic deaths in the United States. The same year, more than 1.1 million people were arrested for driving under the influence of drugs or alcohol. The Florida Department of Highway Safety and Motor Vehicles reported that 849 people were killed in alcohol-suspected fatalities in Florida in 2013, accounting for 34 percent of all traffic deaths in the state.
