New Haven, CT (Law Firm Newswire) July 6, 2011 – The family of Joseph Borselio is finally getting some closure three years after a deadly drunk-driving accident killed their son. Borselio was fatally struck on his bicycle by Douglas Moore. Moore had been at Dave & Buster’s in West Nyack, New York and was allegedly over served alcoholic drinks. Borselio’s family sought legal representation from Stratton Faxon Law Firm and initiated a lawsuit against Moore and four of Dave & Buster’s restaurant executives. Dram shop laws can make restaurants, bars, and other commercial entities liable for death or injuries that are caused when a patron has a drunk-driving accident.

Right before court proceedings were set to begin in May, the national restaurant chain settled with the family. Even though Dave & Buster’s still denies the claims that it over served Moore, the confidential multimillion dollar settlement is justice for the family.

“As you would expect, this was yet another very stressful time for the family, so they were pleased to be able to put this matter behind them,” said the Borselio family’s attorney, Eric Smith of Stratton Faxon law firm.

Moore is serving four years in jail for the incident. He had a blood-alcohol level of 0.21 at the time of the crash. The legal limit in New York is 0.08. Moore did plead guilty to manslaughter with a motor vehicle and after he serves jail time he will have three years of probation and community service.

“Dave & Buster’s policy of encouraging excessive consumption of alcohol in large containers is inappropriate in our society given the repeated horror of innocent lives being slaughtered by drunken drivers,” said Connecticut wrongful death attorney Michael Stratton, who also worked on the case with Eric Smith.

Stratton Faxon Law Firm wanted to take the case to trial after Dave & Buster’s repeatedly denied the claims of over serving Moore. Their experienced legal team knew that Borselio’s family deserved compensation for his potential life earnings as well as the misconduct and negligence by Moore and the restaurant and its bar staff.

The Stratton Faxon trial attorneys are accomplished in wrongful death and serious injury cases. The firm vigilantly protects victims’ rights and the right to trial by jury. They are one of the top three plaintiff personal injury law firms in the state and recipients of the Connecticut Super Lawyers award six years in a row.
