Dallas, TX (Law Firm Newswire) November 28, 2011 – OSHA’s new whistleblower rules should make for more thorough and complaint investigations, according to Dallas business attorney Ty Gomez.

The new rules manual for whistleblower investigators calls for more thorough investigations as OSHA increases the number of investigators.

“An increase in the number of agents investigating whistleblower claims inevitably means an increase in lawsuits filed,” said Gomez. “Employers facing whistleblower claims need to hire an attorney who understands the new regulations and how they affect investigations and cases.”

Among the changes at OSHA’s Whistleblower Protection Program, investigators will be more thoroughly trained in interview techniques, complainants will have to be interviewed by OSHA and the whole program will likely be better funded, according to a release from OSHA.

The association enforces whistleblower laws in 21 areas from clean air and asbestos to solid waste and toxic substances.

“It is vital that you keep a cool head if you are approached by OSHA’s whistleblower investigators,” Gomez said. “You must contact an attorney immediately to discuss your case.”

The Occupational Safety and Health Act of 1970 requires employers to provide healthy and safe work environments for employees. Whistleblower protection guidelines were put in place to guard against employers retaliating against whistleblowing employees.

“Do not terminate your whistleblowing employee until you speak with an attorney with experience in this kind of investigation,” Gomez said. “You can certainly compound your problem by firing somebody in the heat of the moment.”

An attorney with experience in workplace safety regulations can help a company react to accusations and respond appropriately. Gomez has more than 17 years of experience in business law. In his practice, he has worked both with businesses and individuals dealing with whistleblower and Qui Tam cases.
