Administration Takes Additional Steps to Attract Immigrant Entrepreneurs

Dallas, TX (Law Firm Newswire) January 11, 2013 – A new online resource center is available for immigrant entrepreneurs.

A team at U.S. Citizenship and Immigration Services (USCIS) tasked with improving access to work visas for immigrant entrepreneurs recently marked a major milestone by launching an online resource center.

The resource center, called Entrepreneur Pathways, is a project of the USCIS Entrepreneurs in Residence (EIR) initiative.

Dallas immigration lawyer Stewart Rabinowitz praised the program in a statement, saying “The Entrepreneurs in Residence initiative is a laudable program seeking to build on the creative spirit of foreign nationals who want to bring their ideas and energy to the United States by helping such persons steer through the U.S. immigration system.”

Entrepreneur Pathways helps entrepreneurs understand which visa categories are available to them, how to apply, and what evidence they would need in order to demonstrate eligibility. USCIS Director Alejandro Mayorkas announced the public debut of the project at an event held at the Martin Trust Center for MIT Entrepreneurship in Cambridge, Mass.

Launched earlier in 2012, the EIR initiative has already: designed and implemented training programs for USCIS officers focusing on startups; modified certain Request for Evidence templates to allow for new types of evidence; and planned quarterly meetings with representatives of the entrepreneurial community to continue to solicit feedback.

Mr. Rabinowitz concluded by pointing out the burden small businesses face in complying with the current laws, adding, “Beneath the gloss of welcoming words lives an immigration agency whose culture often yields death to new, small business cases by requests for voluminous evidentiary detail for many new office L-1 intracompany transferees and for new business H-1B cases. Frequently, the actual standard of proof to overcome is beyond any reasonable doubt as to the bona fides of their case. If the Administration is serious about welcoming foreign talent, it must exercise an about face in its attitude, which for an organization as vast as USCIS, is not an easy task.”
