Personal Injury Claim Arises As The Result Of A Wildlife Park Tram Ride

Waxahachie, TX (Law Firm Newswire) July 15, 2013 – A Harris County father has brought a lawsuit against a wildlife park after his son was injured.

The suit filed against Animals of the Earth Inc. alleges that a child was injured during a tram ride in 2012 at the park owned by the defendant company. The petition was filed in Galveston County District Court on June 19 by Arthur Reyna, Sr. and on behalf of Mr. Reyna’s minor child. Mr. Reyna claims that the Bayou Wildlife Park tram operator drove the vehicle negligently when Mr. Reyna and his son were visitors to the park in May of 2012.

“Open-area parks such as wildlife parks can appear to have fewer equipment and grounds safety issues, when compared to amusement parks,” stated John Hale, a Waxahachie personal injury lawyer. “But the same public care must be taken, and the same care must be taken by owners to ensure a safe environment for visitors.”

According to Mr. Reyna, a tram driver drove too close to a fence on the Bayou Wildlife Park property, and struck the fence. The claim states that the fence had protruding wire, which made contact with Mr. Reyna’s child’s right arm. Mr. Reyna alleges that the fence was damaged prior to the event and was in a dangerous condition, which the defendant company had knowledge of, but did not properly warn or instruct the public. Mr. Reyna further alleges that the defendant company failed to make the fence “reasonably safe for children to use in order to view the wildlife park and its animals.” The lawsuit states that the child was forced to undergo numerous surgeries on his arm after the accident, for which the plaintiffs seek unspecified monetary damages.

Bayou Wildlife Park, owned by Clint Wolston, is a private animal reserve according to its website, which he has been improving for more than 30 years. The trams stated in the lawsuit are Jeep-hitched vehicles which take visitors throughout 80 acres of woods and prairie in order to see and feed more than 50 species of free-range animals, while instructed by a tour guide.
