Certified Nursing Assistant Allegedly Assaulted Two Nursing Home Residents

Little Rock, AR (Law Firm Newswire) October 25, 2013 – A male nursing assistant tells police he gets turned on while helping elderly female patients at his job.

“This reported case began as a complaint from a 59-year-old woman who had just had hip surgery and stated a nursing assistant slipped into her bed and had non-consensual sex with her,” explained Arkansas injury lawyer, Michael Smith. “The whole situation began to unravel when another resident also said the same man inappropriately fondled her while he assisted her in using the restroom.”

When the first patient filed a complaint with nursing home administrators, the police were called and an internal investigation was launched. The results of that investigation determined the woman’s claims were unfounded, due to the woman’s unstable mental status, chronic health problems and confusion.

The nursing aide was allowed to return to work, and had been there for a month, before another resident, a 73-year-old woman, filed a complaint that he had sexually assaulted her while helping her to use the washroom facilities. The allegation was similar in nature to the first complaint about the man, and the police were called once more. The aide was arrested and admitted to police he was “turned on” at work and that he had made sexual advances and contact with the two women who filed complaints.

“There were no other existing arrest records for the nursing aide, but the home’s administrator would not comment, when asked, on whether or not they had run a background check before he was hired. Certainly something that would need to be done when hiring people to work with fragile patients,” added Smith.

The man admitted he made sexual contact with two patients and had been operating under-the-radar while employed at the home. While the administration may not have been aware of his actions, until they came to light, they may have been able to prevent these incidents from happening had they done a complete background check,” Smith remarked.
