Southfield, MI (Law Firm Newswire) November 1, 2013 – This series of medical negligence complaints had a bizarre outcome. The accused doctor is allowed to keep his medical license and practice.

“Even though the surgeon in this unusual case has been allowed to keep his license to practice, it would not stop the families of those claiming medical negligence from suing him. Apparently the doctor was accused of defrauding Medicare of over $30,000, incompetence and negligence,” indicated Daren Monroe, of Litigation Funding Corp., Michigan.

The initial complaint registered against the Tulsa surgeon included the names of 23 patients who sustained serious complications after the man performed surgery on them. Two ended up paralyzed, and one died. The lengthy complaint has been pending before the state medical board for over three years.

“In a move that baffled the victims, the board voted 4-3 to allow the surgeon to continue his medical practice, provided he paid a hefty fine, completed continuing medical education and did not actively practice until he finished a spine fellowship,” Monroe explained. The board stated they felt the decision helped to protect the public.

The surgeon was quoted as saying the allegations were false and that his competitors were attempting to discredit him due to his success with a new type of surgery. Whether that is the case or not, it does not address the complaints filed by 23 patients with neurological injuries, nor does it offer any form of comfort to the two who were paralyzed or the family of the person who died.

“Should those complainants choose to file medical negligence lawsuits, they would have a long wait before their case(s) would come to trial. In the meantime, they need to pay bills and they would include catastrophic medical expenses. How could they pay those bills while waiting for justice?” asked Monroe.

The perfect answer for them may be to contact a litigation funding company and find out how to apply for a lawsuit cash advance, also referred to as pre-settlement funding. The idea behind advance lawsuit funding is to help plaintiffs cope with their expenses while they are trying to get better and move forward with their lives. Many are not able to work, have lost wages and may never work again, thanks to their injuries. Litigation funding may be the best alternative answer to a difficult financial situation.
