California Judicial Branch Recommends Divorce Mediation, Not Divorce Court

Orange County, CA (Law Firm Newswire) September 23, 2014 – In their information about the process of divorce, the California Courts recommend that all couples consider mediation.

“It is unsurprising that the California Judicial Branch officially recommends divorce mediation,” said Gerald Maggio, a California divorce attorney and mediator. “Right now, California family court judges are dealing with an enormous backlog of cases. And many are divorce cases that wind up up simply as a division of debts because the couple has spent all of their assets on divorce attorneys.”

In the State of California, all divorces take a minimum of six months to be finalized. But with ongoing negotiation and delays in court dates, contested divorces can take much longer. The California Courts website points out that methods of resolving a divorce out of court, such as mediation, can significantly reduce the amount of time it takes to complete a divorce.

The California Courts also point out that couples need not agree on all issues for a successful mediation. If couples can use mediation to reach an agreement on some issues, they can reduce the amount of money and time spent in court resolving the remaining issues.

In their discussion of mediation, the California Courts place the most emphasis on the benefits that mediation passes on to children. The Courts suggest that resolving issues in mediation can help minimize the conflict and resulting emotional turmoil that children of divorce experience.

Maggio agrees, adding, “If this recommendation causes more divorcing parties to engage in mediation of some kind, it will be better not only for our overloaded court system, but it will also produce much healthier divorce outcomes for families, and especially for their children.”
