Austin, TX (Law Firm Newswire) January 22, 2016 – A drunk driver with a yen for fast food landed behind bars when the police caught up with him after he rammed his car into a Sonic in Denison.

It was a Sunday morning, about 10:15 a.m. when the man turned in to the Austin Street Sonic going way too fast. Losing control, he crashed into the wall, causing cooking equipment on the other side to shift.

As a result of the jostling, the cooking grease slopped out and landed on the back of the assistant manager, resulting in second-degree burns. She was taken to hospital and treated and is expected to recover.

Not wanting to hang around and explain to police what happened, the driver took off, but was subsequently arrested later, thanks to a sharp witness who wrote down the vehicle’s license plate number. “Henry Burns was charged with intoxicated assault, driving while under the influence and accident involving injury or death,” said Austin personal injury attorney, Bobby Lee of Lee, Gober & Reyna, who is not involved in this case.

According to the Texas Department of Transportation (TxDOT) there was at least one crash every 66 seconds in 2014 and more than 237,941 were injured in 2014 — an injury every two minutes and 13 seconds. The figures releases by the TxDOT also indicate a 3.7 percent hike in the accident rate over 2013. In 2013, there were 3,408 deaths in collisions. In 2014, there were 3,534 deaths. Alcohol was indeed a factor in some of the accidents.

“Drinking and driving is one of those things that we all know is dangerous. However, some still do drive while under the influence, thinking nothing will happen to them, they won’t get caught or they have everything under control. This particular accident clearly shows the impaired driver did not have everything under control,” said Lee.

Lee represents plaintiffs in cases like this one and if the injured assistant manager chose to sue for medical expenses as a result of her second-degree burns, she would need to speak with an experienced lawyer to file a personal injury lawsuit.
