Student Fainted and Died at High School Football Practice Said Litigation Funding Corporation

Southfield, MI (Law Firm Newswire) February 10, 2016 - A 16-year-old student suddenly fainted, collapsed and died during his high school football practice at Curtis High School in Staten Island, New York.

He was a tall young man and weighed in at 295-pounds. At 16 years of age, he had his whole life ahead of him. His parents filed a wrongful death lawsuit against the city, emergency workers at the scene and education officials for failing to provide their son with adequate medical care.

According to the statement of claim filed in this wrongful death lawsuit, there was no defibrillator on hand, something that may have saved the teenager. His post-death diagnosis by the medical examiner indicated he died of hypertrophic cardiomyopathy, a heart muscle condition. The claim further alleges that despite routine physicals, there had been no problems detected.

When a sudden death upsets the whole fabric of a family, those left behind to grieve are often not only distraught, but face unexpected extra expenses. They are also left with many decisions to make with regard to the deceased and whether or not to file a wrongful death lawsuit to send the named defendants a clear message that such a tragedy should never happen again to anyone else.

The teenager’s family may find the solution to a cash shortage while waiting for their case to go to trial, or be settled, by finding out more about pre-settlement funding. “Pre-settlement funding, also referred to as a lawsuit loan or litigation funding, is emergency cash sent directly to a qualified plaintiff once their case and application has been approved,” said Daren Monroe, Litigation Funding Corporation representative.

Litigation funding can be a lifesaver for plaintiffs suddenly faced with extraordinary expenses in addition to the usual monthly expenses such as the mortgage, rent, school loans or car loans. Life does go on after a sudden death, but it does not need to be a painful financial struggle in addition to the devastation of losing a loved one.

Plaintiffs appreciate the many benefits of a lawsuit loan. They are not required to go through a credit check, they do not have to be working, there are no fees up front or later, they do not need to deal with rapacious insurance companies wanting them to settle fast, and should the case be lost in court, the plaintiff keeps the pre-settlement funding with no strings attached.
