Austin, TX (Law Firm Newswire) November 9, 2016 – Driver distraction may have been a factor in this fatal collision.

This fatal crash occurred, in September, in San Antonio. It involved a white pickup truck and a dump truck. Two were left dead and three were injured as a result of this accident on FM 1937 and U.S. 281 South.

When police arrived on the scene, they found two vehicles in opposite ditches. The road was littered with debris from each truck. The two-lane country road was relatively narrow and the collision had been a head-on, with one vehicle clipping the other, sending each in opposite directions. The wreck killed the pickup driver, an adult male, and a 12-year-old boy.

Three other individuals in the pickup truck sustained critical injuries, including a 2-year-old boy ejected from his booster seat who ended up with a compound leg fracture. The other two victims, an 11-year-old male and a 32-year-old female, both with internal injuries, were airlifted to the nearest hospital after being extracted from the mangled truck.

According to the police report and reconstruction of the accident, the pickup was heading south on FM 1937 and was weaving back and forth into the oncoming lane of traffic. Witnesses said the heavily loaded dump truck tried to reduce speed and pull over as far as possible but had nowhere to go when the white pickup veered into its lane.

The ensuing collision saw each truck clipping the front of the other causing the pickup to roll over into the ditch. The front left side of the smaller truck was sheared off. “While police do not suspect alcohol was the causative factor in this accident, they do suspect a distracted driver at the wheel of the pickup,” said Austin trucking accident lawyer Brooks Schuelke, not involved in the case.

If driver distraction was the cause of this collision, the dump truck driver and the other passengers in the white pickup may be able to seek compensation for their injuries and/or file a wrongful death lawsuit.
