Shot in Head with Air Rifle, Patient’s Surgery Delayed

Southfield, MI (Law Firm Newswire) January 3, 2017 - A California woman went to an emergency room after she had been shot in the head with an air rifle. A delay in treatment resulted in a traumatic brain injury.

The woman waited for five hours and by the time she was transferred to another hospital for surgery, she was barely conscious. Attending doctors at the second hospital rushed her into surgery, but the intracranial bleeding had exerted so much pressure on her brain that she sustained a traumatic brain injury. She now requires around-the-clock care.

The plaintiff’s family filed a medical negligence lawsuit and were subsequently awarded $12 million. During the trial, expert witnesses testified that had she been operated on earlier, her outcome would not have been as severe.

The plaintiff’s family could have applied for pre-settlement funding to assist them in paying their daughter’s medical bills and other expenses. Victims and their families can face financial difficulties as their attorney works on their case. While waiting until the case is resolved, savings may be exhausted, credit cards maxed out, and loans may not be an option.

“Litigation funding may be the best answer for mounting expenses and lost income,” suggested Daren Monroe, Litigation Funding Corporation representative. “Presettlement funding allows a plaintiff the freedom to wait for the highest possible settlement from the courts or other negotiations on their matter.”

A lawsuit loan does not require monthly payments, a credit check or even that the plaintiff be working. No payments are made whatsoever until the case is finalized. If the case is lost, repayment of the lawsuit loan is waived.
