Florida Jury Awards 10 Million in a Florida Wrongful Death Lawsuit

Tampa, FL (Law Firm Newswire) March 6, 2017 – A jury issued a $10 million verdict in a Florida wrongful death lawsuit.

Richard Wiederhold, a Brevard County district fire chief, was left paralyzed from the chest down after a crash with a delivery driver for Domino’s Pizza. Wiederhold’s wife Yvonne had to take care of his daily needs, including bathing him and feeding him through a tube, until 15 months after the accident, when he died of his injuries.

“When a loved one is lost due to another person’s negligence, it is only fair that the family obtain compensation from the wrongdoer,” said Robert Joyce, a Tampa wrongful death attorney with Joyce & Reyes, who is not involved in the case.

The Wiederholds first filed a personal injury lawsuit in February 2011, but after Richard Wiederhold died in March 2012 from blood clots that were related to his paralysis, the lawsuit became a wrongful death case.

The accident occurred in Christmas, Florida on January 13, 2011, when the delivery driver attempted to merge into a lane. Richard Wiederhold swerved to prevent a collision, but his automobile flipped and struck a tree. Yvonne Wiederhold was a passenger in the vehicle and suffered cuts to her legs.

The jury held Domino’s Pizza liable for the crash, assigning 90 percent fault to the delivery driver and 10 percent fault to Wiederhold. That means that Yvonne Wiederhold will potentially receive 90 percent of the $10 million verdict. The damages are for pain and suffering, loss of companionship and mental anguish. Domino’s had previously agreed to pay medical expenses.

Domino’s said that the delivery driver was an employee of a franchise owner and “did not work for us.” The company plans to request a new trial and file an appeal if the request is denied.
