National Origin Lawsuit Filed Against Fidelity Home Energy

Los Angeles, CA (Law Firm Newswire) May 29, 2019 – Home improvement contractor firm Fidelity Home Energy, based in San Leandro, California has been accused of using discriminatory practices and thereby creating a hostile work environment for employees in a lawsuit filed by the U.S. Equal Employment Opportunity Commission (EEOC.)

A former employee of the company, Ayesha Faiz who is of Afghan descent, became upset when she learned that Fidelity Home Energy discriminated against customers who were thought to be of Indian or Middle-Eastern descent. Employees were instructed to turn away anyone who was perceived as Indian or Middle-Eastern by routinely placing their names on “do not call” lists and marking them as disqualified in a central database.

Faiz was expected to do this while she worked there, and to instruct her subordinates to do the same. She voiced her concerns to her fellow supervisors but never learned why the company discriminated against some customers. After three weeks of employment with Fidelity Home Energy, Faiz quit. She cited undue distress caused by the discriminatory practices.

“While discriminating against certain customers is illegal in and of itself, it also violates the rights of the employees who must carry out the discriminatory practices,” said attorney Betsy Havens, executive director of Strong Advocates. “Ms. Faiz was subjected to an extremely hostile work environment in this situation.
