Time Warner Cable and Charter Communications Involved in Disability Discrimination Lawsuit

Los Angeles, CA (Law Firm Newswire) July 29, 2019 - Telecommunications companies Time Warner Cable, Inc. and Charter Communications, Inc. will pay $99,500 to settle a workplace discrimination lawsuit filed by the U.S. Equal Employment Opportunity Commission (EEOC).

According to the charges made by the EEOC, Time Warner Cable terminated an employee who was recovering from a surgery to remove a malignant nodule in her thyroid. She required a leave of absence from her job at Time Warner Cable after the procedure, but, ten days into her time off and three weeks before she was to return, she was fired.

The EEOC accused the company of illegal termination for failing to provide the woman with adequate and necessary accommodations after her surgery. This is a clear violation of the Americans with Disabilities Act of 1990 (ADA), which prohibits discrimination against disabled workers.

“Employers bear the responsibility of knowing the law as it relates to their employees,” said Betsy Havens, executive director at Los Angeles employment law firm Strong Advocates. “Employers must provide reasonable accommodations for temporarily disabled employees. Needing a brief time to recover from a life-saving surgery is generally not a fireable offense.”

The suit was filed in the Central District of California after Time Warner Cable and Charter Communications failed to reach an out-of-court settlement through a conciliation process. In addition to the $99,500 settlement, Time Warner Cable and Charter Communications must also act to prevent future discrimination. The companies are required to review and update company policies, provide regular ADA training to all employees, and report accommodation requests and complaints. The companies will also be under EEOC monitoring for compliance.
