Austin, TX (Law Firm Newswire) April 27, 2020 – Recently there was a serious accident on U.S. Highway 59 near Leggett. Two were killed in a collision with a large truck.

The accident happened near the intersection of Farm-to-Market 942. As a Mercedes-Benz was leaving a parking lot to the west side of the highway it was hit by a Kenworth heading south. Both of the car’s occupants were pronounced dead at the scene.

The Kenworth driver may be liable for the accident. An investigation into the accident will determine liability. Among other things, the investigation would be looking to see if the trucker was speeding, driving while distracted, under the influence or suffered a medical emergency.

A number of factors are considered by large truck accident attorneys when assessing a commercial truck accident. Those factors may include whether or not the trucker lost control of the vehicle, was driving while fatigued, experienced a tire blowout, was drifting from lane to lane, had a disabling or non-disabling vehicle failure, or was improperly maneuvering the truck.

“Depending on the final outcome of the investigation of this accident, surviving family members may be able to file a wrongful death claim,” explained Austin big rig attorney, Brooks Schuelke. “The survivors may seek damages for a variety of things, including: emotional distress, loss of companionship, and pain and suffering.”

Most wrongful death claims are a way for grieving families to get the message out that such accidents should never happen again. These types of cases also shine a light on negligent actions or practices that need to be stopped in order to protect others.

After an accident the surviving family members are likely to hear form insurance companies promising them a settlement. However, the first goal of insurance companies is to reduce or deny the claim and to pay out as little as possible. As a result of that policy, serious injury cases do not get the same consideration without an attorney working on behalf of the surviving family. “It is always in your own best interests to speak to a truck accident attorney to ensure you get the compensation you need and deserve in the wake of a serious track accident,” said Schuelke.
