MyPhillyLawyer Secures a 1.75 Million Dollar Settlement for Permanently Injured Trucker

Dean Weitzman, Esq.

Philadelphia, PA (Law Firm Newswire) July 22, 2021 - MyPhillyLawyer attorneys Dean Weitzman and John Lord successfully obtained a $1.75 million settlement for their injured client, Eric Davis. Mr. Davis was 28 years old when his car hauler co-driver went off Interstate 80, totaling the truck.

Mr. Davis was ejected from the truck's sleeper and sustained significant disc herniations in his lumbar and cervical spine. He was starting his career as a long-haul trucker. Mr. Davis was permanently disabled by his injuries and four subsequent spinal surgeries.

MyPhillyLawyer filed suit against the truck driver, Andriy Prionyuk, and the car hauler owner. The lawsuit aimed to prove that Mr. Davis' medical care was reasonable and necessary due to his serious injuries. The suit also sought to determine whether Mr. Davis was an employee of the car hauler owner, the at-fault driver or an independent contractor. Mr. Davis' employment status was important for purposes of immunity from a suit under the Pennsylvania Workers' Compensation Act.

According to expert testimony, Mr. Davis was permanently disabled, and past and future medical care were required. Although there were no formal documents between Mr. Davis, the at-fault driver, or the car hauler owner, an industry expert stated the car hauler owner was responsible for the accident per the Federal Motor Carrier Safety Act (FMCSA). The FMCSA places responsibility on the carrier for the actions of its drivers – whether or not they are workers or independent contractors.

"The case settled on the steps of the courthouse, just before jury selection," stated Dean Weitzman, Esq., "and it is going to provide Mr. Davis with financial security for the rest of his life."
