Mr. Davis’ employment status was important for purposes of immunity from a suit under the Pennsylvania Workers’ Compensation Act. 
 
According to expert testimony, Mr. Davis was permanently disabled, and past and future medical care were required. Although there were no formal documents between Mr. Davis, the at-fault driver, or the car hauler owner, an industry expert stated the car hauler owner was responsible for the accident per the Federal Motor Carrier Safety Act (FMCSA). The FMCSA places responsibility on the carrier for the actions of its drivers – whether or not they are workers or independent contractors.
