Muncie man charged with murder

Indianapolis, IN (Law Firm Newswire) July 07, 2022 – A Muncie man charged with murder hired Indianapolis criminal defense attorney, Mark Nicholson. He filed a motion in the Muncie court that his client may not be competent to stand trial for murder.

Murder

Jason De’Andre Harris, 33, is charged with fatally shooting Erik Sparks, 28. Under Indiana Code 35-42-1-1, murder is defined as knowingly or intentionally killing another human being. The police allege this is what Mr. Harris did.

Police say Mr. Harris killed Sparks after forcing him to walk with him on Cardinal Greenway north of McGalliard Road in Muncie, Indiana. The police charged the man with murder.

Mr. Harris is accused of murder, criminal confinement, unlawful possession of a firearm possession by a serious violent felon, theft, and obstruction of justice.

Mental Health Exams

Attorney Mark Nicholson of Indianapolis has asked mental health doctors to examine his client to determine his competency to stand trial.

In his motion, he said Mr. Harris is unable to aid in his defense preparation, unable to remember events connected with the case, and has a prior history of mental illness.

Delaware County Circuit Court Judge Thomas Cannon, Jr. appointed psychologist Bob Hatfield and psychiatrist Craig Buckles to examine Mr. Harris. They will discuss Mr. Harris and give their report to the court.

The man charged with murder, Mr. Harris, is scheduled for January. 9, 2023, jury trial in Muncie.

Attorney Nicholson said he wanted his client to undergo mental health exams “to promote the interest of justice.”

In Indiana, if someone is convicted of murder, they face 45 to 65 years in prison, and face a fine of up to $10,000. Attorney Nicholson represents people charged with violent crimes. He is known as The Battery Man known for representing people charged with various battery crimes
