Texas Driver DUI Kills Young Father

Austin, TX (Law Firm Newswire) November 19 , 2012 – Do not drink and drive is not an empty request. Drinking and driving kills, as it did in this case.

“This case is heartbreaking for everyone, more so for the family of the 26-year-old man that died, leaving behind two young children. The man died when the car he was riding in, spun out of control due to clipping a concrete median, left the road, and flipped into a creek,” recounted Austin personal injury attorney Bobby Lee, of Lee, Gober and Reyna in Austin, Texas.

The accident happened about 1:15 a.m. in Bexar County, on Shaenfield Road. Young Justin Lambaria was riding with a friend, Jordan Lopez, who was allegedly driving drunk. He survived the crash, but his life will never be the same again. Carrying the knowledge that he killed his friend, leaving two youngsters without a dad, will likely haunt him every waking day.

When the police arrived on the scene, they detected alcohol on Lopez’s breath, and he was subsequently charged with intoxication manslaughter, while receiving medical attention at the hospital.

Cases like this are more than just a loss of life. They are a major upheaval for everyone. The death of a family member as the result of a drunken driver is never comprehensible, and picking up the pieces afterwards is agonizing. “There are two kids left wondering where their dad is, and a family asking how could this happen. It happens when people negligently drink to excess and then negligently drive. Every action has a consequence. The consequences in this instance were brutally final,” added Lee.

Driving under the influence
in Texas is a crime, as it is in all states, and yet people still flaunt the law. Many think it just does not apply to them, only to find out later, it does — if they live. And, even then, the same drunk driver may repeatedly hit the road while completely inebriated and kill again. “How do you educate people to ‘listen’ to the message that drinking and driving kills? It is disturbing that so many think they are above the law and that drinking and driving rules do not apply to them, when they clearly do,” Lee said.

  • Left turns are deadly for bikers
It’s no secret that riding a motorcycle can be dangerous. Even safety gear cannot protect against death if there is an accident and the impact is “blunt force.” There are advantages and disadvantages about riding a motorcycle. The advantages include having a smaller vehicle, one that costs less to gas up, one that is less expensive to register, a vehicle that easy to park, the enjoyment of the wind on your face and the views you can have on a ride makes for some spectacular trips. The disadvantage to riding a bike is the kill rate when one is involved [...]
  • Snow and booze do not mix
It’s tough enough driving in snowy weather without being drunk. It’s a true miracle that the victim in this crash was able to survive with a broken arm, and not end up dead in a wreckage of twisted metal and glass. It was a cold, blustery, wintery night and a bad storm was dumping snow faster than snowplows could keep up with it. The highway was touch and go, with limited visibility, swirling snow, drifting snow and icy patches. Those traveling on the road were moving slower than the posted speed limit, because it was the smart thing to do. [...]
  • Bellwether transvaginal mesh lawsuits begin December 2013
Just about daily, more transvaginal lawsuits are filed across the nation. The suits being filed daily are the tip of the iceberg. The massive number of complainants has prompted the judicial system to pull everything together under one umbrella; a situation referred to as mass tort litigation or multidistrict litigations. Given the number of cases and the serious injuries involved, not to mention the length of time it would take to get all the cases to trial, due to preparation time, a U.S. district judge announced that the first five bellwether trials involve defendants American Medical Systems (MDL 2325), Boston [...]
